Confidentiality

Evidence Code Sections 1035-1036.2 provide a client confidentiality privilege or “confidential communication” between the sexual assault victim counselor (who has completed 40 hours of required training) and the victim. The victim is the holder of the privilege. This means that sexual assault victim counselors cannot share information about the survivor with anyone without the expressed consent of the survivor or by order of the court following an in-chamber hearing by the judge.
